Disclaimer of Liability

Privacy Policy

This is a legal document that sets out your rights and obligations and those of Chemtogether. All visitors and registered members are bound by this agreement each time they access the Chemtogether site and/or its services. Please read this document carefully.

Definitions

"Chemtogether" - the website identified by the url: www.Chemtogether.com

"User" - by accessing any part of Chemtogether you become a "user" of Chemtogether and you agree to be bound by these Term and Conditions.

"Member/Registered member" - by registering you become a registered member of Chemtogether and you agree to be bound by these Term and Conditions.

"We/us" - the legal owners of Chemtogether

"You" - the user or member

1. Registration & Membership

1.1. Registration

To register you must be a minimum of 16 years of age.

To register you must complete the registration form in as much detail as you are happy to share.

The only required information is: your name, country and email address.

Some personal details (marked distinctively) and your email address will not be accessible by or made available to any other member. It is strictly for internal use so that we may easily communicate with you.

Our database works on a simple principal: the more information you provide about yourself, the more you will be able to see about other members.

Once you completed the registration form you must choose a username and you will be given a password. Your username is the same for log-in and what you will be known as in the forum. We'll then email you to confirm your username and allocate a password. If you want to change your password, you can do so in your profile in the forum or when you log in.

You can change and update your details for changing circumstances any time after you log-in by clicking the register button.

If you wish to unsubscribe please email us. We will terminate your username and password and they will become invalid immediately. We will also remove your details from our database.

1.2 Membership

Once you registered you become a registered member of Chemtogether and you can access the members’ areas and services of Chemtogether using your username and password.

You may access the Chemtogether Service on the basis that:-

  • your username and password are personal to you and may not be used by anyone else
  • all information you submit about yourself on the registration form is accurate and true
  • you are wholly responsible for everything you do on or through the Chemtogether site
  • you will not do anything which would assist anyone who is not a registered member to gain access to the members’ areas and services of Chemtogether.
  • you will not use your access to Chemtogether, or information gathered from it, for the sending of unsolicited bulk email (sometimes known as spam).
  • You acknowledge that we are not and cannot be held responsible for the behavior of Members - whether on the Chemtogether website or outside of it. We only provide a venue where members can exchange information. We do not pre-screen or monitor the material contributed by Members.

    If, for any reason, we believe that you have not complied with any of these Terms and Conditions, we may, at our discretion, cancel your access to Chemtogether immediately and without giving you any advance notice, and if applicable, any refund of your Membership fee.

    We reserve the right to suspend or terminate any Member’s access to Chemtogether, and/or to edit, or require the Member to edit, material posted on Chemtogether if the relevant Member or material appears to us to be in breach of any provision of this Agreement. Any person whose access has been suspended or terminated must not re-register without our prior consent.

    1.3 Privacy

    Chemtogether’s privacy policy is part of this Agreement, and by agreeing to this Agreement, you also give your consent to the way we may handle your personal data in that policy.

    For security or other reasons, we may require you to change password or other information that facilitates access to Chemtogether.

    1.4 Membership fee

    Membership is currently free.

    We reserve the right to change this policy and introduce a membership charge and a minimum membership period. You will be notified of any such change and given the opportunity to become a paying member but you will be under no obligation to do so. We may offer special terms to existing members. If you decide not to continue to be a member according to the new terms, your free access will be terminated and your details will be removed from our database. We also reserve the right to change the amount of the fee for membership, the period it covers, the services it enables you to access and other factors. However, these changes will not affect your then-current Membership.

    2. Services

    Chemtogether is an online networking venue for the people employed in or connected with the chemical and related industries. Only registered members may use the Chemtogether facilities.

    2.1 Forum

    In the forum you are known by the same username you use for log-in. In the forum you may initiate or respond to other member’s topics, ideas or views, exchange private messages, observe the ongoing discussions.

    Chemtogether are not responsible for any material written and exchanged by members nor are for the views of other members. Any views, ideas, facts posted or discussed in the Forum are the responsibility of their author. We do not pre-screen or monitor any material contributed by Members.

    As a dedicated member you may wish to become a moderator or administrator of the forum. This is a responsible task. Chemtogether will screen any potential candidates and must give our written consent. A moderator or administrator can edit, modify, delete topics in the forum and has the power to remove any material that they reasonably believe is unsuitable. However they are not responsible for any views expressed by members nor are they allowed to change or delete members' submissions unless they clearly can show that these are contrary to our terms and conditions.

    For further terms and conditions regarding the use of the forum we refer you to Clause 3.4.

    2.2 Search Facility

    The search facility allows you to search our database in as many combinations of fields as you are allowed. You may look for new employers, employees, clients, suppliers, ex-colleagues, old school friends or just other people with like interests in the industry.

    You may not download or print any of the database for anything else other than for your own private use.

    2.3 Other Facilities

    Chemtogether may offer new or additional services without prior notice. Your use of those services may be subject to additional terms and conditions, or rules of use, which you must comply with. Provided that those terms and conditions or rules are notified to you by Chemtogether, any failure by you to comply with a material provision of the terms or rules governing those services will amount to a breach of this Agreement.

    Chemtogether reserves the right to withdraw or modify any aspect of the Chemtogether Services.

    There may be times when Chemtogether becomes temporarily unavailable for technical reasons whether on a regular or irregular, scheduled or unscheduled basis.

    3. Material

    For the purpose of this agreement, "material" means any material published on Chemtogether including, without limitation, all text, images and graphics of any nature whatsoever, regardless of whether the copyright or any other intellectual property rights rest with us or a third party.

    3.1 General

    You may download and print extracts from the material and make copies of these for your own personal use only. You are not allowed to download or print the material, or extracts from it, in a systematic or regular manner so as to create a database in electronic or paper form comprising all or part of the material appearing on Chemtogether.

    You must not reproduce any part of Chemtogether or the material or transmit it to or store it in any other website or disseminate any part of the material in any other form, unless we have indicated that you may do so.

    We may be prepared to allow you to distribute or reproduce other parts of Chemtogether or the material, in certain other circumstances. Please e-mail the Web editor at enquiries@Chemtogether.com if you wish to ask for permission to do so.

    We reserve the right to use any material you may choose to send to us. If we use your material on Chemtogether you will be asked to whom the material should be accredited or alternatively whether you would prefer the material to be uploaded without accreditation.

    We reserve exclusive editorial rights on all material forwarded to us for use on Chemtogether and other associated websites.

    3.2 Material posted by members on Chemtogether

    We do not accept any liability for material supplied and posted on Chemtogether by any registered member. We refer you to the Disclaimer of Liability at clause 4 below.

    You warrant that any material that you submit to Chemtogether is free from viruses and will not have any detrimental or contaminating effect upon this website and/or any registered members of Chemtogether.

    You remain ultimately responsible for any material that you post on Chemtogether and warrant that the comments or information supplied are true and accurate. You agree that you will not post any material that is subject to copyright or not otherwise owned by yourself.

    You agree that you will not submit material which is untrue, defamatory, abusive, or otherwise in breach of any applicable law. We reserve the right to remove from Chemtogether any material submitted by you.

    You shall indemnify us against any claims or losses, expenses or liabilities howsoever incurred (including legal expenses and other professional fees) arising as a consequence of your breach of any of the terms of this condition.

    3.3 Third Party Material on Chemtogether

    You will see advertising material submitted by third parties on Chemtogether. Individual advertisers are solely responsible for the content of advertising material which they submit to us, including ensuring that it complies with relevant legislation. We accept no responsibility for the content of advertising material, including, without limitation, any error, omission or inaccuracy therein.     3.4 Chemtogether Forum

    You are responsible for ensuring that no material you post, or which is posted through a machine on which you access Chemtogether, nor any activity or communication you make in connection with any Chemtogether Service, will be capable of (a) infringing the intellectual property or other rights of any person or entity, (b) breaching any applicable law, whether criminal, tortious or otherwise, or (c) appearing to be offensive, threatening, obscene, pornographic, false, unreliable or misleading.

    Each Member acknowledges that we are entitled to withdraw any material which appears on Chemtogether which we determine to be capable of breaching any part of this Agreement or bringing Chemtogether into disrepute. However, each user acknowledges that we do not monitor material which appears on the Chemtogether Forum, and that we are reliant upon all users to notify us of anything you see here which appears likely to breach this Agreement.

    4. Disclaimer of Liability

    Please note that despite the above terms and conditions some members may provide information, or otherwise behave, in a way that is unreliable, misleading or even illegal. Some people may not be who they say they are.

    We have no control over or responsibility for the truth or accuracy of any material available on Chemtogether, whether provided by Members or others. We do not give any warranty as to the availability, accuracy, completeness, currency or reliability of the information and material published on Chemtogether and expressly disclaim on behalf of Chemtogether and any party contributing material (to the maximum extent permitted by law) all liability for any damage or loss resulting whatsoever and howsoever from your use of or reliance on the information and material published on Chemtogether. Accordingly, to the extent that the law permits, you release Chemtogether and its directors, contractors and employees from all liability arising out of or in connection with Chemtogether and the material included here by Members and other third parties.

    Your use of Chemtogether is entirely at your own risk.

    You can access other sites via links from Chemtogether - we are not responsible in any way for any of their contents.

    We give no warranties of any kind concerning Chemtogether or the material therein. In particular, we do not warrant that Chemtogether or any of its content is virus free. You must take your precautions in this respect as we accept no responsibility whatsoever for any infection by virus or other communication or by anything which has destructive properties.

    You acknowledge that your use of Chemtogether may be subject to interruption or delay. We do not give any warranty that Chemtogether or the services offered through it will be error free, without interruption or delay, or free from defects in design or engineering.

    We will not be liable to you or any third party for any indirect or consequential loss or damage, or for any loss of data, profit, revenue or business, howsoever caused (whether arising out of any negligence or breach of this Agreement or otherwise). Chemtogether will also not be liable for any failure to perform of its obligations under this Agreement caused by matters beyond its reasonable control.

    Without limiting the preceding Clause, during any period of twelve months, the aggregate liability of Chemtogether under this Agreement (whether arising in negligence or otherwise) will not under any circumstances exceed an amount equal to the sums paid by you to us by way of Membership fees during the relevant period of twelve months, regardless of the cause or form of action.

    Nothing in this Agreement limits Chemtogether’s liability for death or personal injury resulting from our negligence, or any other liability which may not by law be excluded. Any statutory rights you may have as a consumer remain unaffected.

    You agree to indemnify us against all liabilities, claims and expenses that may arise from any breach of this Agreement by you or through a machine on which you access Chemtogether

    We reserve the right to assign this Agreement, and to assign or subcontract any or all of our rights and obligations under this Agreement. You may not without the written consent of Chemtogether assign or dispose of this Agreement.

    5. Privacy Policy

    5.1 Data Protection

    Chemtogether is committed to protect the privacy of its member’s information and complies with the data protection laws that apply in the UK. The proper registration has been made by IDMA Ltd, the legal owner of this site and its contents.

    5.2 Sharing and use of information

    All information about yourself you voluntary give to us but not all will be available to other members.

    We will not directly make our members’ email address available to others on the Chemtogether site. Members however may exchange this information between themselves, if they so wish. Nor will some other personal information (as stated clearly and marked distinctively on the registration form) be available to see by other members.

    Your email address will be held by us so that we can communicate with you regarding the Chemtogether site.

    We will only use your personal data for our own statistical purposes and for the benefit of the Chemtogether members. We will not supply nor sell any of your data to third parties. The only circumstances in which we will provide your personal data to a third party are:

  • We may include interactive advertising for other businesses. We may provide an anonymous analysis of Member’s data to target this advertising appropriately
  • We may share data supplied by you with our subsidiaries and other companies in our group but only for the purposes described in this policy
  • If Chemtogether and its assets are acquired by a third party we would transfer all data to that party having first given our members proper notice so that they could withdraw their details prior to such transfer should they wish to do so
  • All other information you give to us will be available to other members.

    We may recommend newsletters and other services we think you might find useful. You will be asked by email if you wished to subscribe to this. You are under no obligation to do so.

    5.3 Cookies

    We may use cookies (small files on your computer) to hold your login and registration information.

    Temporary session cookies are also used, for example, to change Log in to Log out in the menu bar. These cookies disappear when you move from the site or close your browser.

    Third-party cookies may also be used in the future to track advertisements.

    5.4 Security

    We take all the necessary measures to protect our member database and access to this database is restricted.

    However, it remains all members’ responsibility:

  • To keep your password secret
  • To protect against unauthorized access to your details
  • To make sure you log out when you don’t use the Chemtogether Services
  • To ensure that whilst you are logged on no one is able to use your machine
  • You may terminate your membership any time and we shall remove all details from our servers.

    6. Intellectual Property

    You acknowledge that all copyright, trade marks, and other intellectual property rights in and relating to Chemtogether (including the material which is contributed by Members) are owned by Chemtogether. You may not copy, distribute, show in public or create any derivative work from Chemtogether, or any of the material which is found on Chemtogether unless properly licensed to do so by us.

    The software that operates the Chemtogether site is under license from IDMA. You may not copy or utilize any part of it. If you wish to licence this software please email here.

    7. Variations

    This agreement and your use of Chemtogether shall be governed by English law and the parties agree to submit to the exclusive jurisdiction of the English courts.

    No tax, legal or investment advice of any kind (including advice and opinions with respect to the nature, potential value or suitability of any particular securities transactions, financial products or investment strategy) is being provided by us (or any party contributing material to Chemtogether) to you. Any tax, legal or investment decisions made by you will be based solely on your own evaluation of your own circumstances and not on the basis of any information given in Chemtogether.

    Any changes to these Terms and Conditions will be made available via Chemtogether at least 7 days in advance of the changes taking effect and you will be deemed to have agreed to the terms and conditions by accessing Chemtogether following the changes taking effect.

    This Agreement includes our disclaimer together they contain the whole of the agreement between us and you concerning Chemtogether and they replace all earlier agreements and understandings with you, except for any fraud or fraudulent representation by either of us. A person who is not a party to this Agreement has no right under the Contracts (Rights of Third Parties) Act 1999 to rely upon or enforce any term of this Agreement.
